1. Terms & Conditions of Website Use

• Intellectual Property: All content—including text, images, graphics, trademarks, logos, directories, and software—is owned by or licensed to MTI Trading Inc. Unauthorized copying, distribution, modification, reproduction, or commercial use without prior written consent is strictly prohibited.
• Accuracy of Information: MTI Trading Inc. makes reasonable efforts to present accurate, up-to-date information, but makes no warranties or representations as to its accuracy and assumes no liability for errors or omissions.
• Disclaimer of Warranties (“AS IS”): Your use of this website is at your own risk. All content and services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied (including implied warranties of merchantability, fitness for a particular purpose, or non-infringement).
• Limitation of Liability: Neither MTI Trading Inc. nor its affiliates shall be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your access to or use of the website.
• Indemnification: You agree to defend, indemnify, and hold harmless MTI Trading Inc., its officers, directors, agents, and licensors from any claims, losses, costs, or expenses (including legal fees) resulting from your violation of these terms or misuse of site content.
• Governing Law & Jurisdiction: This website is operated from California, USA. This agreement is governed by the laws of the State of California. Any legal claims must be filed exclusively in the State or Federal courts located in Orange County, California.
• Policy Revisions: MTI Trading Inc. reserves the right to update these terms at any time. Continued use of the site constitutes acceptance of updated terms.

2. Shipping & Handling Policies

Shipping Coverage & Processing

• Delivery Areas: We ship only within the 50 U.S. states. Orders to foreign countries, U.S. territories, P.O. Boxes, or military bases cannot be fulfilled and will be cancelled.
• Processing Time: Standard orders process within 72 hours (excluding holidays) via UPS Ground or USPS.
• Expedited Shipping: Next Day, 2nd Day, and 3rd Day shipping options are available by calling for a quote.
• California customers are charged 9.25% sales tax unless a valid Resale Permit is provided.

Additional Fees & Customer Responsibilities

• Oversized Item Surcharge: Items longer than 48″ (e.g., Bos) incur an extra $23.50 UPS handling fee.
• UPS Address Correction Fee ($19.50): Ensure your shipping address is accurate. If UPS requires an address correction to deliver your package, a $19.50 fee will be charged to the credit card on file.
• Refused or Undeliverable Packages: If a package is returned due to customer refusal or an invalid address, original and return shipping charges plus carrier refusal fees will be deducted from your refund.
• Signature & Availability: Customers are responsible for being available to receive delivery at business locations requiring signatures. Items returned due to customer unavailability are not eligible for a refund on original shipping costs and may incur return fees.

3. Returns & Exchanges

Guidelines & Eligibility

• Timeframe: Returns and exchanges are accepted within 14 days of the purchase date.
• Return Authorization (RA): You must request and obtain an RA Number via email prior to returning any item.
• Condition: Items must be in new, unused, and resalable condition in original packaging (not worn, washed, soiled, altered, or damaged). Non-resalable items will be shipped back at the customer’s expense.
• Foam Equipment Care: Do not pack foam sparring equipment tightly or attach Velcro straps during return shipping, as this causes permanent wrinkling. Wrinkled foam gear will be returned to the customer at their expense.
• Final Sale Items: The following items are non-returnable and non-exchangeable:

   

  • Clearance, sale, and custom items
  • Silk-screened uniforms and bags
  • Mouthguards, groin cups, and supporters

Fees & Process

• Restocking Fee: A 20% restocking fee applies to all non-defective returns. The remaining balance will be credited to your card within 5 business days (allow up to 30 days for it to reflect on your statement).
• Exchanges: Replacement items are subject to new shipping fees.
• Return Shipping: Customers are responsible for return shipping costs. Using a trackable service with delivery confirmation is strongly recommended.

How to Return an Item

1. Pack the item securely in a suitable shipping box.
2. Enclose a copy of your invoice or written RA number, indicating “RETURN” or “EXCHANGE” (specify replacement size/color).

4. Care Instructions for Screen-Printed Items

Warranty Notice: All warranties on screen-printed uniforms and T-shirts are void if exposed to hot water, bleach, fabric softeners, direct ironing, or hot dryer heat.

5. Martial Arts Safety & Legal Disclaimer

• Age Limit & Legality: By placing an order, you confirm you are of legal age (18+ for weapons) and legally permitted to purchase, possess, and receive the ordered items in your state or locality.
• Weapons Usage: All weapons are sold strictly for demonstration, forms, display, or expert-supervised training. They are not intended for contact or sparring. Inspect weapons before every use.
• Practice Recommendations: MTI Trading Inc. recommends that instructors limit beginners and children to foam-covered, foam rubber, or wooden practice items.
• Sparring & Protective Gear: Martial arts sparring gear is designed only for light, supervised contact to reduce injury risk. It is not rated for full-contact sparring, boxing, or heavy bag work. Always wear complete, properly fitted protective gear.
• Assumption of Risk: Martial arts practice carries inherent risks of physical injury. You agree to consult a physician before training and to hold MTI Trading Inc. harmless from any injury or liability resulting from product use or misuse.
