MTI Trading Inc. Sales Policies, Product Warranties, and Arbitration Terms

IMPORTANT NOTICE:

By keeping and using products purchased from MTI Trading Inc., you agree to the terms, limited warranties, disclaimers, and binding arbitration provisions outlined below.

If you do not agree with these terms: You must return the unused product within 14 days from the date of purchase for a refund.

1. High-Risk Activity & Safety Disclaimers

General Martial Arts Warning

Equipment and gear sold on this website are intended for Karate, Tae Kwon Do, Judo, Kung Fu, and other martial arts styles.

  • Assumption of Risk: Participation in martial arts is a high-risk activity. You expressly and voluntarily assume all risk of personal injury, disability, or death resulting from participation, whether caused by product malfunction, negligence, or any fault of MTI Trading Inc.

  • Medical Consultation: Consult a physician before engaging in any martial arts training or using high-risk equipment.

Martial Arts Weapons Policy

  • Intended Use: Weapons are intended strictly for demonstration, forms practice, collection, or display. They are NOT for contact, sparring, or self-defense.

  • Age Restrictions & Compliance: Weapons will not be sold to anyone under 18 years of age without parental consent. Buyers are solely responsible for compliance with local, state, federal, and international laws regarding ownership, possession, and legal age.

  • Inspection: Inspect weapons before every use. Do not use any product showing signs of wear or damage.

  • Liability Release: MTI Trading Inc. disclaims all liability for improper, illegal, or unintended use, or modifications made to any weapon.

2. Limited 30-Day Product Warranty

MTI Trading Inc. warrants its products to be free from defects in materials and workmanship for 30 days from the date of purchase, subject to the following conditions:

  • Coverage Limit: Liability is strictly limited to repairing or replacing non-abused, defective products returned prepaid to MTI Trading Inc.

  • Original Purchaser: This warranty applies only to the original purchaser listed on the sales invoice within the boundaries of the United States.

  • Exclusions & Natural Variations:

    • Wood Items: Natural characteristics (flex, memory, knots, or slight bowing across various lengths) are inherent to wood and are not considered defects.

    • Misuse: Warranty is void if the item has been subjected to abuse, neglect, accident, improper use, or unauthorized alteration.

Non-Returnable & Custom Items

  • Final Sale: Custom-striped belts, embroidered belts, and silk-screened garments are non-returnable.

  • Embroidery Orders: Must be submitted using the official EMBROIDERY FORM.

  • Silk-Screen Issue Reporting: Any issues with silk-screened uniform orders must be reported within 5 days of receipt.

3. Care Guidelines & Screen-Print Warranty Notice

To preserve screen-printed apparel, follow these specific washing instructions:

  • Washing: Wash garments inside out in cool water using a gentle detergent and gentle cycle. Do not mix with harsh fabrics (e.g., jeans) to prevent surface abrasion.

  • Drying & Care: Air-dry or tumble dry on low heat.

  • Prohibited Care: Do NOT use bleach or fabric softeners, iron directly over prints, wash in hot water, or use high dryer heat.

WARRANTY VOID NOTICE:

All warranties on screened uniforms and T-shirts become null and void if the item is exposed to hot water, bleach, fabric softeners, direct ironing, or a hot dryer cycle.

4. Warranty Disclaimer & Limitation of Liability

  • Disclaimer of Implied Warranties: The 30-day limited warranty is provided in lieu of all other warranties, express or implied—including warranties of merchantability or fitness for a particular purpose.

  • Cap on Liability: In no event shall MTI Trading Inc.’s liability exceed the actual purchase price of the sold item.

  • Consequential Damages: MTI Trading Inc. is not liable for any special, incidental, or consequential damages resulting from product use or site usage, to the maximum extent permitted by applicable law.

5. Website Disclaimers & Errors

Product descriptions, typographical errors, pricing mistakes, and photographic inaccuracies are unintentional and subject to correction. MTI Trading Inc. reserves the right to reject or cancel any order placed for a product listed at an incorrect price without liability.

6. Governing Law, Claims Limit & Mandatory Arbitration

All purchases and disputes are governed by the laws of the State of California, U.S.A. (excluding choice-of-law provisions and the 1980 U.N. Convention on Contracts for the International Sale of Goods).

Dispute Resolution Agreement

NOTICE: BY ENTERING INTO THIS AGREEMENT, YOU WAIVE YOUR RIGHT TO A TRIAL BY JUDGE OR JURY IN A COURT OF LAW FOR ALL CLAIMS OVER $8,000.00.

Claim Amount Resolution Method & Venue
Up to $8,000.00 Filed exclusively in the Small Claims Division of the District Court of Orange County, California.
Over $8,000.00 Resolved exclusively through binding arbitration under the California Uniform Arbitration Act in Orange County, California, before a single neutral arbitrator. The award rendered is final, binding, and enforceable in court.

  • Statute of Limitations: Any claim or cause of action arising from a purchase or website use must be commenced within one (1) year after the claim arises, or it is permanently barred.

  • No Waiver: Failure by MTI Trading Inc. to enforce strict performance of any provision shall not be construed as a waiver of any right or term.
